Content on the Platform

Scope and Standard of Conduct

Opengates is a professional platform for freelancers, clients, and businesses. The rules in this Section apply to every piece of content submitted, uploaded, transmitted, streamed, linked to, or otherwise made available on or through the Platform, in any format — including text, images, video, audio, files, code, live communications, chat messages, profiles, listings, portfolios, deliverables, external links, and metadata.

These rules are strict and non-negotiable. Opengates operates a zero-tolerance posture toward the categories identified in this Section as strictly prohibited. Ignorance of these rules, automated posting by third-party tools, and content posted by others using your account are not defenses.

User Content Ownership

When you post, upload, or share content on the Opengates Platform, you retain ownership of your intellectual property. This includes any text, images, videos, designs, or other creative materials you create. What you post remains yours; Opengates does not claim ownership of your content.

By sharing content on the Platform, you grant Opengates a limited, global, non-exclusive, royalty-free license to use, display, reproduce, transmit, and cache your content solely for the purpose of operating, providing, securing, and moderating the Platform's services. This includes displaying your portfolio to potential clients, enabling project collaboration, facilitating user-to-user interactions, running automated safety scans, and retaining evidence of Terms violations.

This license does not permit Opengates to:

• Use your content for marketing or promotional purposes without your explicit consent.
• Create derivative works from your content.
• License, sell, or sublicense your content to third parties.
• Use your content for training artificial intelligence or machine learning models beyond the internal safety, fraud, and content-moderation systems described in the "Content Moderation" section below.

Upon account deletion, Opengates will remove your content from the Platform within 30 calendar days, unless retention is required for legal compliance, active disputes, contractual obligations, ongoing investigations, or preservation of evidence relating to prohibited content.

Client Ownership of Commissioned Work

Content created by a Freelancer for a Client under a contract is owned by the Client upon full payment, unless otherwise agreed in writing between the parties. By accepting a contract, the Freelancer agrees to assign all intellectual property rights in the deliverables to the Client upon payment completion. Opengates does not retain any license to client-commissioned work beyond what is necessary to facilitate delivery through the Platform.

Strictly Prohibited Content — Zero Tolerance

The categories in this Section are strictly prohibited. A single violation may result in immediate, permanent, and irreversible account termination, forfeiture of pending balances to the extent permitted by law, preservation and disclosure of your data to law enforcement, and referral to the appropriate authorities. No warning will be issued.

1. Child Sexual Abuse Material (CSAM) and Child Endangerment

You must not create, upload, post, share, link to, request, solicit, produce, distribute, promote, or otherwise engage with:

• Any sexual, sexually suggestive, or exploitative content depicting, describing, or appearing to depict any person under the age of 18, whether real, illustrated, animated, computer-generated, AI-generated, morphed, deepfaked, or fictional.
• Content that sexualizes minors in any way, including "aged-up" characters, roleplay involving minors, or fictional narratives with sexual content involving minors.
• Grooming behavior, sexual solicitation of minors, or attempts to arrange in-person or online contact with minors for sexual purposes.
• Non-sexual content that endangers minors, including physical abuse, exploitation, trafficking, or child labor content.

Opengates has an absolute zero-tolerance policy for the above. All confirmed and reasonably suspected CSAM will be reported to the U.S. National Center for Missing & Exploited Children (NCMEC), the Internet Watch Foundation (IWF), and applicable national authorities. Related account data, IP logs, device identifiers, payment records, and communications will be preserved and disclosed in accordance with 18 U.S.C. § 2258A and equivalent legislation in other jurisdictions.

2. Adult, Sexual, and Sexually Suggestive Content

Opengates is a safe-for-work Platform. You must not upload, post, share, transmit, stream, link to, offer, or solicit:

• Pornography, hardcore or softcore, in any format.
• Sexually explicit or graphic sexual content, including written erotica.
• Nudity, partial nudity, or exposure of intimate body parts, whether photographic, illustrated, painted, computer-generated, or AI-generated. Limited exceptions may apply only to (a) verified medical, scientific, or educational contexts pre-approved in writing by Opengates, and (b) fine-art contexts that comply with applicable law and are clearly non-sexual; Opengates retains sole discretion to determine whether an exception applies.
• Sexually suggestive imagery, poses, framing, clothing, captions, or descriptions intended to sexualize the subject.
• Fetish, kink, or BDSM content of any kind.
• Escort services, sugar-dating, "companionship" services, sex work, adult webcam or streaming services, or the solicitation, advertisement, or facilitation of any of the foregoing.
• Adult products, toys, paraphernalia, subscriptions, or memberships offered for sale, trade, promotion, or affiliate marketing.
• Non-consensual intimate imagery, including so-called "revenge pornography," upskirt/downblouse imagery, hidden-camera intimate imagery, and imagery obtained through hacking, coercion, or breach of trust.
• Deepfake, face-swap, morphed, or AI-generated sexual, nude, or intimate content depicting any identifiable real person, whether or not that person is a public figure, and regardless of consent claimed by the uploader.
• Content that sexualizes violence, injury, or death.

3. Violence, Terrorism, and Violent Extremism

You must not upload, post, share, stream, glorify, promote, recruit for, fundraise for, or organize:

• Graphic violence, gore, mutilation, torture, or animal cruelty.
• Terrorism, terrorist organizations, terrorist propaganda, or content produced by or on behalf of entities designated by the U.S., EU, UK, UN, or similar sanctions lists.
• Violent extremist movements, mass-casualty attackers, or content that celebrates, memorializes, or valorizes them.
• Credible threats of violence against any person, group, or property, including doxxing paired with threats.
• Instructions, tutorials, or facilitation for manufacturing weapons, explosives, incendiary devices, chemical, biological, radiological, or nuclear (CBRN) materials, 3D-printed firearms, or firearm-conversion devices.
• Recruitment for, or coordination of, real-world violence, riots, or "raids" against individuals or communities.

4. Hate Speech and Targeted Harassment

You must not use the Platform to attack, dehumanize, threaten, or incite hatred, discrimination, or violence against any individual or group on the basis of race, ethnicity, national origin, caste, immigration status, religion, sex, gender, gender identity, sexual orientation, disability, serious disease, age, or veteran status. This includes:

• Slurs, dehumanizing metaphors, or calls for exclusion, segregation, or elimination.
• Content denying, minimizing, or celebrating historic acts of genocide, mass violence, or slavery.
• Symbols, logos, and iconography of hate movements, unless used in a clearly documented educational, counter-speech, or journalistic context.
• Targeted harassment, stalking, bullying, coordinated pile-ons, or repeated unwanted contact directed at any individual.
• Outing of a person's sexual orientation, gender identity, immigration status, HIV status, or other private attribute without consent.

5. Illegal Goods, Services, and Regulated Activity

You must not use the Platform to offer, promote, advertise, facilitate, arrange, or complete transactions involving:

• Controlled substances, illegal drugs, drug precursors, drug paraphernalia, or prescription medications outside of a lawful prescription channel.
• Firearms, ammunition, explosives, incendiaries, tasers, silencers, ghost-gun kits, or firearm-conversion devices.
• Human trafficking, forced labor, organ trafficking, smuggling of persons, or commercial sexual services.
• Live animals, endangered species, or products derived from endangered species (CITES-listed).
• Counterfeit goods, replicas passed off as authentic, or goods that infringe trademarks or trade dress.
• Stolen goods, stolen data, stolen credentials, stolen payment instruments, or unlawfully obtained intellectual property.
• Gambling, lotteries, sports betting, or casino services not licensed in the user's jurisdiction and Opengates' jurisdiction of operation.
• Unregistered securities, Ponzi or pyramid schemes, "get-rich-quick" schemes, high-yield investment programs (HYIPs), or unlicensed money services.
• Unlicensed provision of legal, medical, psychological, tax, immigration, or financial-advisory services.
• Cryptocurrency mixers, tumblers, sanctions evasion services, chain-hopping services, or "cash-out" services for illicit funds.
• Any product or service that is unlawful in either the user's jurisdiction or the jurisdiction of the recipient.

6. Fraud, Deception, and Financial Crime

You must not:

• Impersonate any person, business, government agency, brand, or Opengates itself.
• Falsify identity documents, verification documents, portfolios, credentials, reviews, or work history.
• Operate multiple accounts to circumvent bans, ratings, promotions, or restrictions.
• Engage in phishing, credential harvesting, invoice fraud, wire-fraud attempts, business-email-compromise attempts, romance scams, advance-fee scams, or "refund" scams.
• Engage in money laundering, structuring, chargeback fraud, triangulation fraud, or the movement of funds derived from unlawful activity.
• Provide "review farming," fake engagement, or artificial ranking manipulation.
• Conduct off-platform payment circumvention designed to evade fees, escrow, or dispute protections.
• Use the Platform to advertise, refer, or funnel users to fraudulent external services.

7. Malware, Security Abuse, and Platform Integrity Attacks

You must not:

• Upload or distribute malware, spyware, ransomware, keyloggers, rootkits, cryptominers, remote-access trojans, or any code designed to damage, disable, or gain unauthorized access to systems.
• Upload or sell exploits, zero-days, or hacking tools targeted at Opengates or third parties without lawful authorization.
• Probe, scan, penetration-test, load-test, scrape, or reverse-engineer the Platform without prior written authorization.
• Attempt to bypass, disable, or interfere with authentication, rate limits, anti-fraud, or moderation systems.
• Deploy automated agents, bots, scrapers, or crawlers against the Platform except as permitted under a public API license.
• Use the Platform's messaging, upload, or transactional features to attack, defraud, or compromise third parties.

8. Privacy Violations and Doxxing

You must not upload, post, share, or transmit:

• Personal information of another person without their informed, verifiable consent, including full name, home address, workplace, phone number, government-issued identifiers, financial account details, biometric data, location data, or medical records.
• Content that reveals or attempts to reveal the real identity of a pseudonymous individual.
• Content obtained through unauthorized access, hacking, insider misuse, or breach of a confidentiality obligation.
• Intimate imagery, private communications, or private records of another person without their consent.

9. Self-Harm, Suicide, and Dangerous Behaviors

You must not post content that promotes, glorifies, encourages, provides instructions for, or coordinates:

• Suicide, self-harm, or eating disorders.
• Ingestion of dangerous substances, dangerous "challenges," or extreme dieting regimens marketed as a service.
• Conversion "therapy" services or content targeting sexual orientation or gender identity.

Content that discusses these topics in a safety-focused, educational, journalistic, survivor-support, or clinical context is permitted when compliant with applicable law and Community Guidelines.

10. Intellectual Property and Confidentiality Violations

You must not post, upload, or transmit content that:

• Infringes copyrights, trademarks, patents, trade secrets, publicity rights, or moral rights of any third party.
• Contains DRM circumvention tools, pirated software, cracked licenses, key generators, stolen streaming credentials, or content from unauthorized sources.
• Violates a non-disclosure agreement, confidentiality obligation, or client contract.
• Includes source code, credentials, secrets, keys, or datasets you are not lawfully permitted to share.

11. Spam, Manipulation, and Low-Quality Content

You must not:

• Send unsolicited bulk communications, chain messages, or unsolicited marketing.
• Post content that is repetitive, off-topic, keyword-stuffed, machine-generated at scale without disclosure, or otherwise designed to manipulate search, ranking, or discovery.
• Manipulate ratings, reviews, endorsements, or feedback through fake accounts, incentives, retaliation, or coordinated activity.
• Post affiliate links, referral links, or promotional content in a manner that violates Community Guidelines or applicable disclosure laws.

12. Misinformation That Causes Real-World Harm

You must not post content that is materially false and:

• Undermines public-health guidance in ways that create risk of physical harm (e.g., dangerous fake medical services).
• Suppresses voting, misrepresents election procedures, or incites unlawful interference with elections.
• Impersonates emergency-services communications, or spreads false emergency information (e.g., fake evacuation orders).
• Manipulates markets, securities, or currencies through coordinated false statements.

13. AI-Generated and Synthetic Content

You may use generative AI as part of your creative or professional workflow, subject to the following mandatory rules:

• You must not generate, upload, or transmit any content that would be prohibited if produced without AI. AI does not neutralize a violation.
• You must not generate nude, sexual, or sexually suggestive imagery of any real person, or of any subject depicting or appearing to depict a minor.
• You must not generate deceptive impersonations, voice clones, or likeness clones of any real person without documented, verifiable consent from that person.
• You must clearly disclose to clients when a deliverable is generated primarily by AI, and you must have the rights necessary to license the output.
• You must not use AI to generate content that violates any other provision of these Terms.

Content Moderation — Automated and Human Review

Opengates operates a layered content-moderation program that combines automated systems and human review. By using the Platform, you consent to the following:

1. Pre-publication scanning. All content submitted to the Platform may be scanned by automated systems, including machine-learning classifiers, perceptual hashes, signature matching (including PhotoDNA and equivalent CSAM-detection technologies), URL-reputation checks, malware scanners, and pattern-based detectors, before it is made visible to other users. Content flagged as prohibited may be blocked, quarantined, delayed, or routed to human review.
2. Post-publication monitoring. Content that is published may be re-scanned continuously as classifiers and blocklists are updated. Content that becomes non-compliant may be removed retroactively.
3. Human review. Opengates employs and contracts trained human reviewers ("Trust & Safety Reviewers") to evaluate flagged content, user reports, appeals, and edge cases. Human reviewers may examine any content necessary to enforce these Terms, including private messages, uploaded files, and metadata, subject to the Privacy Policy.
4. Behavioral signals. Opengates may use account age, verification status, historical violations, device signals, IP reputation, payment signals, and other metadata to determine risk scoring, moderation priority, and eligibility for restricted features.
5. Preservation. When content is removed, Opengates may preserve copies of the content, associated metadata, and account records for the purposes of enforcement, dispute resolution, legal compliance, incident response, and evidence preservation. Preservation may extend beyond account deletion where required by law.
6. No guarantee of detection. Opengates does not represent or warrant that all prohibited content will be detected or removed before it becomes visible to other users. The absence of moderation action on a specific item is not an endorsement or approval of that item.
7. Silent action. Opengates may take moderation action without prior notice where notice would defeat the purpose of enforcement, expose victims to retaliation, compromise an investigation, or is prohibited or unnecessary by law.

Enforcement and Consequences

Depending on the severity, frequency, and context of a violation, Opengates may take one or more of the following actions, in any order and without prior warning:

• Remove, hide, quarantine, blur, age-gate, or downrank the content.
• Reduce distribution, disable comments, disable sharing, or remove from discovery.
• Restrict specific features (uploads, messaging, payouts, listings, external links).
• Issue a formal warning or require acknowledgment of these Terms.
• Suspend the account temporarily (24 hours to 90 days).
• Terminate the account permanently and prohibit the user from creating new accounts.
• Withhold, freeze, offset, or forfeit pending balances to the extent permitted by law and by the Payments Terms.
• Report the account, content, and associated data to NCMEC, IWF, IC3, law enforcement, financial regulators, sanctions authorities, and other relevant authorities.
• Cooperate with civil and criminal proceedings, including responding to subpoenas, court orders, and mutual-legal-assistance requests.

Violations of the "Strictly Prohibited Content — Zero Tolerance" section will, by default, result in permanent account termination on the first offense, regardless of intent, and regardless of whether the violation was carried out by an automated tool or a third party using your account.

Reporting Violations

If you encounter content on the Platform that you believe violates these Terms, applicable law, or the Community Guidelines, you may report it through the in-Platform reporting tools or by contacting trust@opengates.app. Reports involving suspected child sexual abuse material should also be reported directly to NCMEC's CyberTipline at www.cybertipline.org. Opengates will review reports promptly and take appropriate action. False, malicious, or automated reports may themselves constitute a violation of these Terms.

Appeals

If your content has been removed or your account has been restricted, you may submit a single written appeal within 14 calendar days by contacting appeals@opengates.app with the case reference provided in your enforcement notice. Appeals are reviewed by a Trust & Safety Reviewer who was not involved in the original decision, except that appeals concerning CSAM, terrorism, or other categories subject to mandatory legal reporting are final and non-appealable on Opengates. In those cases, remedies must be pursued through the relevant governmental authority.

Intellectual Property Rights

You represent and warrant that you have the necessary rights, permissions, and licenses to post your content on the Platform. This includes ensuring that your content does not infringe on the rights of others. If you use third-party materials, you are responsible for obtaining appropriate permissions and providing credit where required.

If you believe your intellectual property rights have been violated on the Platform, you may submit a complaint to support@opengates.app or through the designated intellectual-property notice tool. Opengates operates a notice-and-takedown procedure consistent with the U.S. Digital Millennium Copyright Act (DMCA), the EU Copyright Directive, and other applicable law, and maintains a repeat-infringer policy that will result in account termination for users who accumulate substantiated infringement notices.

Liability for Content

You are solely responsible for the content you submit and for the consequences of submitting it. Opengates acts as an intermediary and does not endorse, verify, or guarantee any user-generated content. To the maximum extent permitted by applicable law, Opengates disclaims liability for user-generated content and for the acts or omissions of any user. Nothing in this Section limits any liability that cannot lawfully be excluded, including liability for gross negligence, willful misconduct, or acts required to be reported under mandatory-reporting statutes.

Changes to These Rules

Opengates may update this Section from time to time to reflect changes in law, moderation practices, and safety needs. Material changes will be announced through the Platform and by email. Continued use of the Platform after an update constitutes acceptance of the updated rules. Where a change would materially reduce your rights, Opengates will provide reasonable advance notice where legally required.
