Content on the Platform

Rules regarding user content, prohibited content, intellectual property, and Platform rights on Opengates.

User Content

When you post, upload, or share content on the Opengates Platform, you retain ownership of your intellectual property. This includes any text, images, videos, designs, or other creative materials you create. What you post remains yours; Opengates does not claim ownership of your content.

By sharing content on the Platform, you grant Opengates a limited, global, non-exclusive, royalty-free license to use, display, and reproduce your content solely for the purpose of operating and providing the Platform's services. This includes displaying your portfolio to potential clients, enabling project collaboration, and facilitating user-to-user interactions.

This license does not permit Opengates to:

  • Use your content for marketing or promotional purposes without your explicit consent.
  • Create derivative works from your content.
  • License, sell, or sublicense your content to third parties.
  • Use your content for training artificial intelligence or machine learning models.

Upon account deletion, Opengates will remove your content from the Platform within 30 calendar days, unless retention is required for legal compliance, active disputes, or contractual obligations.

Client Ownership of Commissioned Work

Content created by a Freelancer for a Client under a contract is owned by the Client upon full payment, unless otherwise agreed in writing between the parties. By accepting a contract, the Freelancer agrees to assign all intellectual property rights in the deliverables to the Client upon payment completion. Opengates does not retain any license to client-commissioned work beyond what is necessary to facilitate delivery through the Platform.

Prohibited Content

Users are responsible for ensuring that their content complies with the law and the Platform's guidelines. You may not post or share content that:

  • Violates intellectual property rights, such as copyrighted works or trademarks.
  • Contains obscene, defamatory, or abusive material.
  • Promotes violence, hate speech, or discrimination.
  • Includes false, misleading, or fraudulent claims.
  • Contains malware, viruses, or other harmful code.

Opengates reserves the right to remove content that violates these Terms, applicable laws, or the Community Guidelines. Persistent violations may result in account suspension or termination.

Platform Rights

Opengates does not pre-screen user-generated content but reserves the right to monitor, review, and remove content that violates these Terms or poses risks to the safety and integrity of the Platform. This includes content flagged by users or identified through automated systems.

Opengates also retains the right to restrict visibility or distribution of certain content if it is deemed sensitive or harmful, even if it does not explicitly violate the Terms.

Reporting Violations

If you encounter content on the Platform that you believe violates these Terms or the Community Guidelines, you may report it to Opengates through the designated reporting tools. We take reports seriously and will review all submissions promptly. Actions taken may include removing the offending content, issuing warnings, or suspending accounts.

Intellectual Property Rights

You represent and warrant that you have the necessary rights, permissions, and licenses to post your content on the Platform. This includes ensuring that your content does not infringe on the rights of others. If you use third-party materials, you are responsible for obtaining appropriate permissions and providing credit where required.

If you believe your intellectual property rights have been violated on the Platform, you may submit a complaint through our support email contact at support@opengates.app. We will address copyright violations in accordance with applicable laws.

Liability for Content

Opengates is not liable for user-generated content posted on the Platform. Users assume full responsibility for the legality, accuracy, and appropriateness of their content. The Platform acts as a host and intermediary, facilitating the sharing and discovery of user content but not endorsing or verifying it.
