Eligibility
To access and use the Opengates Platform, you must be at least 18 years old (the legal age of majority in Kenya). You may not use the Platform if you are barred from receiving services under applicable laws or regulations. Users who have previously been banned or suspended from the Platform for violating these Terms or any other policies are not eligible to create a new account or access the Platform in any capacity.
Identity Verification
To maintain the security and integrity of the Platform, Opengates may require users to complete identity verification (Know Your Customer, or KYC) before accessing certain features, including receiving payments, holding funds in escrow, or withdrawing earnings. Verification may include providing a government-issued identification document (national ID, passport, or equivalent) and other supporting information.
Users must provide accurate and truthful information during the verification process. Providing false or misleading identity documents may result in immediate account termination and forfeiture of pending payouts.
Authorization for Organizations
If you are accessing the Platform on behalf of a business, company, or other legal entity, you confirm and warrant that you have the legal authority to bind the entity to these Terms. You are also responsible for ensuring that all actions conducted through the entity's account comply with these Terms, including adherence to all applicable laws and regulations. Furthermore, the entity assumes full liability for any misuse, violations, or disputes arising from its use of the Platform. When an organization uses the Platform, the terms "you" and "your" apply to both the individual user and the entity represented.
Restrictions
To maintain the integrity and security of the Platform, certain restrictions apply to all users. Misrepresenting your identity, impersonating another person, or creating multiple accounts without explicit permission is strictly prohibited. Additionally, you may not access the Platform using unauthorized methods, such as bots, crawlers, or scraping technologies, as these activities violate the Platform's terms. Any attempts to bypass security features, hack into accounts, or disrupt the Platform's functionality are also strictly forbidden.
Engaging in activities that undermine the safety, usability, or fairness of the Platform, including but not limited to spamming, harassment, or fraudulent behavior, is not permitted. Violations of these restrictions may result in the suspension or permanent termination of your account, as outlined in the Termination section of these Terms.
